1. Acceptance of these terms
These Terms of Service (“Terms”) govern your use of the cash flow management services (the “Service”) operated by American Resurgence Corporation (“we,” “us,” or “our”), including the customer-care SMS / text-messaging program described below. By becoming a customer, enrolling a phone number, or using the Service, you agree to these Terms.
2. The Service
We provide cash flow management services to general contractors and home services businesses, including cash flow planning, support with receivables and payables, and ongoing guidance and customer support. Specific features and offerings may change over time.
3. SMS / text-messaging program (customer care)
- Purpose. Our SMS program is a customer-care program for existing customers: account notifications, service updates, and two-way replies to customer support requests. It is not used for marketing or promotional messages.
- Consent. By enrolling a phone number and checking the consent box on our opt-in page, you agree to receive customer-care text messages from American Resurgence Corporation as described there. Consent is optional and is not required to purchase or use the Service.
- Message frequency. Message frequency varies based on your account and support activity.
- Cost. Message and data rates may apply. Your mobile carrier’s standard rates apply to all messages.
- Opt out. Reply STOP to any message to stop receiving texts. Reply HELP for help.
- Carriers. Mobile carriers are not liable for delayed or undelivered messages.
4. Eligibility and authorization
You must be at least 18 years old to enroll a number. If you enroll a phone number other than your own, you represent and warrant that you are authorized to do so and that each number’s user has agreed to receive these messages.
5. Acceptable use
You agree not to use the Service unlawfully, to submit content you are not authorized to share, or to interfere with the operation of the Service.
6. Disclaimers
The Service is provided “as is” without warranties of any kind, to the fullest extent permitted by law. The Service is not legal, tax, or investment advice. We do not guarantee that messages will always be delivered or processed without error.
7. Limitation of liability
To the fullest extent permitted by law, American Resurgence Corporation will not be liable for any indirect, incidental, or consequential damages arising from your use of the Service or the messaging program.
8. Changes to these terms
We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
